Abstract

The following article focuses on s. 7 of the Charter, analysing the various com ponents of the section and the drafting process which led to their making. The author reviews cases which have interpreted parts of the section as well as other cases which deal with similar legislation in other jurisdictions. He then makes suggestions as to how the section may be interpreted in the future.
